No matter how long a British citizen by Descent has lived in the UK, only the last 3 years of their residency before their child is born counts towards passing on British Citizenship.
Plus they cannot leave the UK for more than 9 months before having a child

British Citizens born overseas, who subsequently spend their whole life, or a significant proportion of their life in the UK, cannot pass on their citizenship to their child.
The Home Office does not allow it

This doesn’t apply to other types of British citizenship — naturalized British citizens (those born abroad but who became British) don’t face this restriction.
All other British Citizenship types can, even if they were born overseas
*FYI - this was intended in the 1981 British Nationality Act (BNA81)
British children (citizens) born overseas, who have a child overseas, even if they spend most or a significant proportion of their childhood in the UK, are denied the same full citizenship rights to pass on their citizenship to their child.
That is just unfair and inequitable
based on Home Office information who were registered as been granted British Citizenship, either because they are related to a British Citizen on the basis of entitlement to registration, or on a discretionary basis.

Irish Citizens who have resided (but necessarily born) in the UK for at least 5 years can apply under the British Nationality (Irish Citizens) Act 2024 (s.4AA BNA81) allows Citizenship by Registration and able to pass on their new citizenship
What about British Citizens by descent who have lived in the UK for as long?
Under section 3(2) of the Act, without the parent having completed a period of three years’ residence., the parents would need to provide evidence that the child does not hold another nationality (this complies with the UK's obligations under the 1961 Convention on the Reduction of Statelessness)

Since 1981, British Citizens moved all around the EU. That ended with Brexit.
But what about the children and their children's children?
There are many citizens who are simply unaware that this may be an issue for them - and their grandchildren.
...which discriminates and prejudices British Citizens by Descent, and their children who are born overseas.
We call upon the UK Government to amend the British Nationality Act 1981 to:
These changes would ensure equal rights for British Citizens by Descent, aligning their ability to pass on citizenship with that of other British citizens, such as those who are naturalized. This would remove discriminatory provisions and create fairer, more consistent citizenship rules for all British citizens, regardless of how they acquired their status..
The British Nationality Act creates a first-generation limit to Citizenship by Descent.
And this was specifically intended in 1981.
But the Act is out of date and requires a rethink about the conflicts it has created over the past 40 years since it was enacted.
We'd love to hear from people who are in the same situation.
It doesn't just affect children, there are many adults who are citizens that affected by this restriction that creates an unnecessary burden on family life for thousand of people.
